Judicial separation of the spouses in the Italian Civil Code

The Italian Civil Code establishes that the separation of the spouses can be a judicial separation or by consensual agreement (certified by the competent Italian Court).

Judicial separation in Italy can be requested when exist situations that make impossible the continuation of the spouses cohabitation or that may cause a serious damage to the children's education.

When the Italian Judge allows the filed lawsuit of separation also declares which one among the two spouses must be considered responsible of the separation according to a behaviour opposite to the marriage obligations if exist the circunstances required and one of the spouses has requested to decalare the other one responsible for the separation.
